ESJ is not a staffing agency, employer, recruiter of record, or employment agency unless explicitly stated for a specific service. Employers and candidates are solely responsible for their hiring decisions, working relationships, compensation agreements, and employment or contractor arrangements.

3. Eligibility

To use the Platform, you must:

  • Be at least 18 years old
  • Have the legal authority to enter into binding agreements
  • Use the Platform in compliance with applicable laws and regulations
  • Provide accurate and truthful information

By using the Platform, you represent and warrant that you meet these requirements.

4. User Accounts

Account Registration

Certain Platform features may require account registration. Users agree to: provide accurate information; maintain updated account details; keep login credentials secure; and notify ESJ of unauthorized account activity. Users are responsible for all activities conducted through their accounts.

Account Suspension or Termination

ESJ reserves the right to suspend, restrict, or terminate accounts at its discretion, including for: violation of these Terms; fraudulent activity; misrepresentation; abuse of the Platform; harassment or misconduct; spam activity; illegal conduct; and marketplace manipulation.

5. Employer Responsibilities

Employers using the Platform agree that they are solely responsible for: hiring decisions; candidate evaluations; compensation agreements; employment classification; contractor classification; payroll obligations; compliance with labor laws; tax obligations; employment agreements; background checks; workplace conduct; and any legal obligations associated with workers engaged through the Platform.

Employers agree not to:

  • Misrepresent opportunities
  • Post fraudulent roles
  • Engage in discriminatory hiring practices
  • Request unpaid labor unlawfully
  • Use the Platform for illegal purposes
  • Circumvent applicable labor laws
  • Harass or exploit candidates

ESJ does not guarantee candidate performance, suitability, availability, or employment outcomes.

6. Candidate Responsibilities

Candidates using the Platform agree that they are solely responsible for: accuracy of profile information; work history representations; skills representations; communication with employers; compliance with local laws; tax obligations; professional conduct; and independent contract or employment obligations.

Candidates agree not to:

  • Misrepresent identity or qualifications
  • Use fraudulent information
  • Engage in harassment or abuse
  • Violate intellectual property rights
  • Submit misleading applications
  • Use automated scraping or spam tools

ESJ does not guarantee employment opportunities, interviews, job offers, or income.

7. Platform Fees and Payments

Employer Fees

Employers may be charged recurring platform fees associated with active workforce relationships or other services offered through the Platform. Current pricing structures are described on the Pricing page and may be updated periodically. Employers agree to: pay all applicable fees; maintain valid payment methods; and authorize recurring billing where applicable. Failure to pay fees may result in: restricted account access; suspension of Platform functionality; and removal of listings or workforce relationships.

Candidate Fees

Unless otherwise stated, candidate participation and profile creation are free.

Taxes

Users are responsible for any taxes, duties, or government fees associated with their use of the Platform.

8. Workforce Relationships

ESJ provides infrastructure intended to facilitate connections between employers and professionals. ESJ is not responsible for: employment relationships; contractor relationships; compensation disputes; workplace disputes; payroll disputes; terminations; benefits; tax withholding; worker classification; performance management; or labor law compliance. Unless explicitly agreed otherwise in writing, ESJ is not the employer of candidates or workers engaged through the Platform.

9. No Employment Guarantee

ESJ does not guarantee:

  • Candidate placement
  • Job offers
  • Hiring success
  • Candidate quality
  • Candidate availability
  • Employer legitimacy
  • Income levels
  • Worker retention
  • Workforce outcomes

The Platform is provided as a self-service marketplace and infrastructure system. All hiring and engagement decisions are made independently by users.

10. Marketplace Standards

To help maintain marketplace quality, users agree to: act professionally; communicate respectfully; use truthful information; avoid spam or abuse; avoid discriminatory conduct; respect applicable laws; and respect intellectual property rights.

ESJ reserves the right to moderate content, remove profiles, remove listings, or restrict access where necessary to protect the Platform or its users.

11. Prohibited Activities

Users may not:

  • Use the Platform unlawfully
  • Violate employment laws
  • Use false identities
  • Circumvent fees
  • Scrape or copy Platform data
  • Use bots or automated systems without authorization
  • Interfere with Platform operations
  • Upload malicious code
  • Engage in harassment or discrimination
  • Post misleading job opportunities
  • Conduct scams or fraudulent activity
  • Attempt unauthorized access to systems or accounts

ESJ reserves the right to investigate and take action against prohibited conduct.

12. Intellectual Property

All Platform content, branding, technology, software, designs, graphics, logos, and materials are owned by or licensed to ESJ unless otherwise stated.

Users may not:

  • Copy Platform content
  • Reproduce branding
  • Reverse engineer software
  • Create derivative works
  • Use ESJ intellectual property without written permission

Users retain ownership of the content they upload but grant ESJ a non-exclusive, worldwide, royalty-free license to host, display, process, and use submitted content for Platform operation and marketing purposes.

13. User Content

Users are solely responsible for content they upload, submit, or share through the Platform. By submitting content, users represent that they: own the content or have permission to use it; are authorized to share the content; and are not violating third-party rights.

ESJ reserves the right to remove content that violates these Terms or applicable laws.

14. Privacy

Use of the Platform is also governed by the ESJ Privacy Policy. By using the Platform, users consent to the collection and use of information as described in the Privacy Policy.

15. Third-Party Services

The Platform may integrate with or contain links to third-party services, websites, tools, or payment providers. ESJ is not responsible for: third-party services; third-party content; third-party policies; third-party availability; or third-party conduct. Use of third-party services is at the user’s own risk.

16. Platform Availability

ESJ does not guarantee uninterrupted Platform availability. The Platform may experience: maintenance periods; service interruptions; delays; technical issues; and feature changes. ESJ reserves the right to modify, suspend, or discontinue portions of the Platform at any time.

17. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, ESJ disclaims all warranties, express or implied, including: merchantability; fitness for a particular purpose; non-infringement; reliability; availability; accuracy; and performance outcomes.

ESJ does not guarantee:

  • Successful hiring outcomes
  • Candidate quality
  • Candidate legitimacy
  • Employer legitimacy
  • Continuous Platform access
  • Revenue or business outcomes

Users use the Platform at their own risk.

18. Limitation of Liability

To the fullest extent permitted by law, ESJ and its affiliates, officers, employees, contractors, and partners shall not be liable for: indirect damages; consequential damages; lost profits; lost revenue; business interruption; data loss; employment disputes; hiring decisions; worker conduct; third-party actions; contract disputes; payroll disputes; or compliance violations by users.

In no event shall ESJ’s aggregate liability exceed the amount paid by the user to ESJ in the twelve (12) months preceding the claim.

19. Indemnification

Users agree to indemnify and hold harmless ESJ and its affiliates, officers, employees, contractors, and partners from claims, damages, liabilities, costs, or expenses arising from: use of the Platform; violation of these Terms; violation of laws; user content; hiring decisions; workforce relationships; employment disputes; contractor disputes; and intellectual property claims.

20. Compliance with Laws

Users are responsible for complying with all applicable laws and regulations related to: employment; contractor relationships; tax obligations; labor laws; payroll; international hiring; data privacy; anti-discrimination laws; immigration laws; and export controls.

ESJ does not provide legal, tax, or employment law advice unless explicitly stated.

21. International Use

The Platform may be accessible globally. Users are responsible for ensuring their use of the Platform complies with local laws in their jurisdictions.

22. Termination

Users may stop using the Platform at any time. ESJ reserves the right to suspend or terminate access to the Platform without notice for violations of these Terms or to protect the Platform and its users.

Certain provisions of these Terms survive termination, including:

  • Intellectual property
  • Disclaimers
  • Limitation of liability
  • Indemnification
  • Payment obligations

23. Changes to These Terms

ESJ may update these Terms periodically. Updated Terms will become effective upon posting. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
